Workers Compensation Terms and Information
Workers Compensation Benefits: Some of the benefits included in workers compensation policies are:
- Disability (temporary total, temporary partial, permanent partial or permanent total);
- Medical (unlimited or amount deemed necessary to restore the employees health. No deductible applies to the employee's benefits);
- Death (burial expense) and weekly payments to dependents; and
- Rehabilitation (physical or occupational).
Employer's Liability: This insurance applies to bodily injury by accident or disease. Bodily injury included resulting death.
Other States Coverage: Provides coverage for workers while working in other states, when the states are listed under 3.C on the Information Page. Coverage will apply if Named Insured begins work in the listed state during the policy term.
Voluntary Compensation & Employers Liability Coverage Endorsement: WC0003 11 is used extend workers compensation benefits to employees who would normally not come under the law (i.e. farm workers, domestic and casual employees).
Remuneration: Usual premium basis is payroll and all other remuneration to any person for whom the insurance would be liable. The insurer may pick up a charge for subcontractors and use the contract price for the services and material if certificates of insurance are not
provided.
Important Workers Compensation Coverage Endorsements:
United States Longshoremen's and Harbors Workers Compensation Act Coverage Endorsement: It is used to provide insurance to workers subject to the federal Longshoremen's and Harbor Workers Compensation Act. The Longshoremen's and Harbor Workers Compensation Act is federal workers compensation law governing maritime employment which included longshoremen, harbor workers, shipbuilders and ship repairers. It does not apply to masters or crews of vessels under 18 tons net.
Jones Act: Applicable to navigable waters used for international or interstate commerce. Seamen are covered by the Merchant Marine Act of 1920, usually called the "Jones Act". The law gives injured seamen a cause of action against employers for negligence.
Federal Employers Liability Act (FELA): Law governing the employment of railroad workers, giving them a cause of action for negligence of the railroad.
